Notice to Parents

DIRECT NOTICE TO PARENTS FOR CHILDREN UNDER THE AGE OF 13 FOR THE LITTLE LONE STARS CLUB

You have registered with the Big Tex Little Lone Stars Club (“Program”) of the State Fair of Texas (“SFT”, “we”, “us”) on behalf of your child, who will receive certain mailings from the SFT. This notice describes our practices of collecting, using, and disclosing personal information from children under the age of 13 that you provide to the SFT. The Children’s Online Privacy Protection Act of 1998 and its rules (collectively, “COPPA”) applies to information collected online from children under the age of 13  (“children” or “child”). As a nonprofit, COPPA does not apply to the SFT, and because the SFT will only collect a child’s personal information from his/her parent and legal guardian (as used in this policy, “parent” or “parents”) directly, COPPA does not apply; however, because the SFT respects the privacy of children, it voluntarily complies with the  COPPA rules regarding the use and disclosure of a child’s personal information provided to the SFT by the parents.

Scope

This notice applies to information collected from you about your child under the age of 13 (“child” or “children”) through your online registration with the Program.

This policy notifies the parent of:

  • the types of information we may collect from the parent regarding his/her child;
  • how we use the provided information;
  • our practices for disclosing such information;
  • our practices for notifying parents on how a parent may revoke consent to use of the child’s information; and
  • all operators, if any, who collect or maintain information from children through this Program.

SFT will not collect, use, or disclose personal information from your child if you do not consent and do not provide such information to the SFT.

Personal Information

We collect personal information about your child only when you, the parent, provide it to us in the online registration form for the Program.

For the Program, we collect:

  • the parent’s email address and zip code; and
  • the child’s name, complete mailing address, birth month, and birth year.

Use and Sharing of Parent Personal Information

We use your personal information to provide you with offers and information regarding the SFT and its programs and services, and we may share your information with third parties that we hire to help us provide Services to you.

We share your information when:

  • we have your consent to share such information;
  • we need to share your information to provide the products, information, or services you have requested;
  • we have third parties assist us in providing promotional materials and information about upcoming events sponsored or produced by the SFT.

Use and Sharing of Your Child’s Personal Information

We do not share, sell, rent, transfer, or share children’s personally identifiable information other than as described in this section.We may disclose aggregated information about many of our website users and information that does not identify any individual or device.

We may disclose children’s personally identifiable information in the following limited circumstances:

  • to third parties whom we use to support the internal operations of the SFT and/or this Program  and who are bound by contractual or other obligations to use the information only for such purpose and to keep the information confidential;
  • if we are required to do so by law or legal process, such as to comply with any court order or subpoena or to respond to any government or regulatory request;
  • if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of SFT, our Internet users, participants in the Program, or others, including to:
    – protect the safety of a child;
    – protect the safety and security of the Program;
    – enable us to take precautions against liability; or
  • to law enforcement agencies or for an investigation related to public safety.

In addition, if SFT is involved in a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of SFT’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding or event, we may transfer the personally identifiable information we have collected or maintained to the buyer or other successor.

Terminating Use of Your Child’s Information.

Please note that the SFT will maintain and use the personal information collected from you, the parent, as noted herein until either of the following occurs:   (1) your child turns 13 yrs. old; or (2) you request that the SFT delete this information and remove his/her child from the Program.

Questions, Deletions, and Corrections Regarding Personally Identifiable Information

If you: (a) have questions or comments about our Policy; (b) wish to make corrections to any personally identifiable information provided by you; (c) want to opt-out from receiving future commercial correspondence, including emails, from us; (d) wish to withdraw your consent to our use of your child’s personally identifiable information and request that we delete such information; or (e) you have other privacy related questions or concern, you can do so by contacting us at:

We will respond to your request and, if applicable and appropriate, make the requested change in our active databases as soon as reasonably practicable. Please note that we may not be able to fulfill certain requests while allowing your child to participate in the Program.
